Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Deco AI website, mobile application, and related services, including any AI-powered design generation features, subscriptions, support communications, and other services we provide through or in connection with Deco AI (collectively, the "Services").

These Terms are entered into between you and DDV Media LLC ("Deco AI," "Company," "we," "us," or "our"). By accessing, downloading, installing, creating an account, purchasing a subscription, or otherwise using the Services, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, you must not access or use the Services.

1. Acceptance of Terms

By using Deco AI, you represent that you are at least 13 years old or the minimum age required to use digital services in your jurisdiction, and that you have the legal authority to enter into these Terms.

If you use the Services on behalf of a company, organization, or other legal entity, you represent that you have authority to bind that entity to these Terms. In that case, "you" and "your" refer to both you individually and that entity.

Your use of the Services is also subject to our Privacy Policy and any additional terms, policies, or notices presented to you in connection with specific features, subscriptions, app store purchases, or promotions.

2. Description of the Services

Deco AI is an AI-powered design application that allows users to upload or provide photos of rooms, home exteriors, gardens, yards, or other spaces and generate visual design concepts, redesigns, style variations, furniture rearrangements, and related creative outputs.

The Services are intended for inspiration, visualization, planning, entertainment, and creative purposes only. Deco AI is not a substitute for professional architectural, interior design, engineering, construction, landscaping, legal, financial, or safety advice.

3. Definitions

For purposes of these Terms:

"App" means the Deco AI mobile application and any related software, website, tools, or interfaces.

"User Content" means any photo, image, text, prompt, file, feedback, or other material that you upload, submit, send, or otherwise provide through the Services.

"Generated Content" means any image, design, rendering, layout, visual concept, recommendation, or other output generated by the Services based on User Content or prompts.

"Subscription" means a paid recurring plan or paid feature that unlocks additional functionality, styles, generations, credits, or access within the Services.

"Device" means any computer, phone, tablet, or other internet-connected device used to access the Services.

"Third-Party Services" means third-party platforms, processors, AI providers, analytics services, app stores, payment processors, hosting providers, or external websites used by or linked from the Services.

4. License to Use the Services

Subject to your compliance with these Terms, Deco AI grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download, install, access, and use the Services for your personal, non-commercial use.

This license does not transfer ownership of the Services or any Deco AI intellectual property to you. We reserve all rights not expressly granted under these Terms.

5. User Content

You retain ownership of your User Content. By uploading or submitting User Content to the Services, you grant Deco AI a limited, worldwide, royalty-free license to host, store, process, reproduce, modify, display, and use that User Content solely as reasonably necessary to operate, provide, maintain, improve, secure, and support the Services, including generating the requested designs and outputs.

You represent and warrant that:

• You own or have the necessary rights to upload and use your User Content;
• Your User Content does not infringe or violate any third-party rights, including privacy, publicity, copyright, trademark, or property rights;
• You have obtained any necessary consent from identifiable individuals, property owners, or rights holders appearing in or connected to your User Content;
• Your User Content does not contain unlawful, harmful, abusive, misleading, or otherwise prohibited material.

You are solely responsible for your User Content and for any consequences arising from uploading, sharing, or using it.

6. Generated Content and AI Outputs

Deco AI uses artificial intelligence technologies to generate visual design outputs. AI-generated content may be inaccurate, incomplete, unrealistic, not unique, or unsuitable for actual implementation.

You understand and agree that:

• Generated Content is provided for inspiration and visualization purposes only;
• Generated Content may not reflect accurate dimensions, structural requirements, building codes, zoning rules, safety standards, material availability, costs, or feasibility;
• You must independently verify any Generated Content before relying on it;
• You should consult qualified professionals before making renovation, construction, landscaping, purchasing, safety, or financial decisions;
• Similar or identical outputs may be generated for other users;
• We do not guarantee that any Generated Content will meet your expectations or be legally protectable.

To the extent permitted by applicable law and subject to your compliance with these Terms, you may use Generated Content for personal, creative, and planning purposes. Commercial use may require our prior written consent unless expressly allowed within the Services or a paid plan.

7. Restrictions

You agree not to, and will not permit others to:

• Sell, rent, lease, sublicense, distribute, or commercially exploit the Services without our prior written consent;
• Modify, copy, adapt, translate, reverse engineer, decompile, disassemble, or create derivative works based on the Services;
• Remove, alter, or obscure any copyright, trademark, or proprietary notices;
• Use the Services for unlawful, harmful, fraudulent, abusive, defamatory, infringing, or misleading purposes;
• Upload content that you do not have the right to use;
• Upload photos of identifiable individuals without appropriate consent;
• Use the Services to generate content that violates applicable law or third-party rights;
• Interfere with or disrupt the security, integrity, or performance of the Services;
• Use bots, scrapers, automated systems, or other unauthorized tools to access or extract data from the Services;
• Attempt to bypass usage limits, subscription restrictions, payment requirements, or security measures;
• Use the Services to train, develop, or improve competing AI models, products, or services without our prior written permission.

We may monitor use of the Services to protect the platform, enforce these Terms, prevent abuse, and comply with legal obligations.

8. Accounts

Certain features may require you to create an account or sign in using a third-party login provider. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

You agree to provide accurate information and to keep your account information up to date. You must notify us promptly if you believe your account has been compromised.

We reserve the right to suspend, restrict, or terminate accounts that violate these Terms or are used in a way that may harm Deco AI, other users, or third parties.

9. Subscriptions, Trials, Payments, and Renewals

Some features of the Services may require a paid Subscription or in-app purchase. Subscription terms, pricing, billing periods, trial availability, renewal terms, and included features will be presented at the time of purchase.

By purchasing a Subscription, you authorize the applicable payment provider, the Apple App Store, or other platform to charge your selected payment method according to the terms shown at checkout.

Subscriptions automatically renew unless canceled before the end of the current billing period or within the timeframe required by the applicable app store or payment provider.

You are responsible for managing and canceling your Subscription through the platform where you purchased it, such as your Apple ID account settings.

Deleting the App does not automatically cancel your Subscription.

10. Free Trials

From time to time, Deco AI may offer free trials or promotional access. Trial terms will be shown when offered.

Unless canceled before the trial period ends, a free trial may automatically convert into a paid Subscription, and the applicable subscription fee may be charged according to the terms presented at signup.

Free trials may be limited to one per user, account, payment method, or device. We reserve the right to modify, revoke, or limit free trials at any time to prevent abuse or misuse.

11. Refund and Cancellation Policy

Because Deco AI provides digital content and immediate access to AI-powered features, purchases are generally final and non-refundable unless required by applicable law or expressly stated otherwise.

For purchases made through the Apple App Store, refund requests are handled by Apple according to its own refund policies and procedures. Deco AI does not directly control app store refund decisions.

If you experience recurring technical issues that are solely attributable to Deco AI and materially prevent your use of paid features, you may contact us at support@decoai.app. We may request screenshots, error messages, logs, account details, or other information needed to investigate the issue.

Canceling a Subscription stops future renewals but does not usually provide a refund for the current billing period. After cancellation, access to paid features generally continues until the end of the current paid period, unless otherwise stated by the applicable app store or payment provider.

12. Intellectual Property

The Services, including the App, website, software, interface, designs, text, graphics, logos, trademarks, icons, images, features, workflows, and underlying technology, are owned by Deco AI, its licensors, or its service providers and are protected by intellectual property and other laws.

Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, sell, lease, publish, display, perform, transmit, or otherwise use any part of the Services without our prior written consent.

No rights are granted to use the Deco AI name, trademarks, logos, brand assets, or other proprietary materials without our prior written permission.

13. Feedback and Suggestions

If you submit feedback, ideas, comments, improvements, feature requests, or suggestions regarding the Services, you agree that Deco AI may use, copy, modify, publish, distribute, and exploit them for any purpose without restriction, compensation, attribution, or obligation to you.

14. Third-Party Services

The Services may include, link to, or rely on Third-Party Services, including AI processing providers, cloud infrastructure, analytics tools, payment processors, app stores, login providers, and external websites.

We do not control and are not responsible for Third-Party Services, including their availability, accuracy, content, security, privacy practices, terms, or performance.

Your use of Third-Party Services is at your own risk and may be subject to separate terms and policies from those third parties.

15. Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, store, and share information. By using the Services, you acknowledge that you have reviewed our Privacy Policy.

16. Copyright Infringement Notice

If you believe that content available through the Services infringes your copyright, please contact us at support@decoai.app and provide the following information:

• A physical or electronic signature of the copyright owner or authorized representative;
• Identification of the copyrighted work claimed to have been infringed;
• Identification of the material claimed to be infringing and information reasonably sufficient to locate it;
• Your name, address, telephone number, and email address;
• A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
• A statement that the information in your notice is accurate and that, under penalty of perjury, you are the copyright owner or authorized to act on behalf of the copyright owner.

We may remove or disable access to allegedly infringing material and may terminate repeat infringers where appropriate.

17. Availability, Updates, and Modifications

We may update, modify, suspend, or discontinue the Services or any part of them at any time, with or without notice.

Updates may add, remove, or change features, functionality, pricing, usage limits, or supported platforms. We are not obligated to provide updates or to continue providing any particular feature.

We do not guarantee that the Services will always be available, uninterrupted, secure, or error-free.

18. Termination

These Terms remain in effect until terminated by you or Deco AI.

You may stop using the Services at any time and may delete the App from your device. If account deletion functionality is available, you may also request or complete account deletion through the App or by contacting us.

We may suspend or terminate your access to the Services at any time if we believe you have violated these Terms, created risk or legal exposure for us, misused the Services, failed to pay applicable fees, or used the Services in a way that may harm Deco AI, users, or third parties.

Upon termination, your right to access and use the Services will immediately cease. Sections that by their nature should survive termination will continue to apply, including provisions relating to intellectual property, AI outputs, disclaimers, limitation of liability, indemnification, dispute resolution, and general terms.

19. Disclaimers

The Services are provided "as is" and "as available," with all faults and without warranties of any kind.

To the maximum extent permitted by applicable law, Deco AI disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and uninterrupted operation.

We do not warrant that:

• The Services will meet your expectations;
• Generated Content will be accurate, realistic, original, feasible, or suitable for implementation;
• The Services will be uninterrupted, timely, secure, or error-free;
• Any defects or errors will be corrected;
• The Services will be compatible with every device, operating system, or platform.

No advice or information, whether oral or written, obtained from Deco AI or through the Services creates any warranty not expressly stated in these Terms.

20. Limitation of Liability

To the fullest extent permitted by law, Deco AI, its affiliates, officers, employees, contractors, licensors, service providers, and suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, lost data, loss of goodwill, business interruption, property damage, renovation costs, construction costs, or substitute services, arising out of or related to your use of or inability to use the Services.

To the maximum extent permitted by applicable law, Deco AI's total aggregate liability for any claim arising out of or related to these Terms or the Services will not exceed the greater of:

• The amount you paid to Deco AI for the Services in the twelve months before the event giving rise to the claim; or
• One hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

21. Indemnification

You agree to defend, indemnify, and hold harmless Deco AI, its affiliates, officers, employees, contractors, licensors, service providers, and suppliers from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Your use or misuse of the Services;
• Your User Content;
• Your violation of these Terms;
• Your violation of applicable law;
• Your violation of any third-party rights, including intellectual property, privacy, publicity, or property rights.

22. Dispute Resolution

If a dispute arises between you and Deco AI, you agree to first contact us at support@decoai.app and attempt to resolve the dispute informally.

Your notice should include your name, contact information, a description of the dispute, and the relief you are requesting. We will attempt to resolve the matter through good-faith informal discussions.

23. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles, unless applicable consumer protection laws in your jurisdiction require otherwise.

Subject to any mandatory rights you may have under applicable law, any legal action or proceeding arising out of or related to these Terms or the Services will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the jurisdiction and venue of those courts.

24. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be interpreted or modified to the minimum extent necessary to make it enforceable. If modification is not possible, the provision will be severed, and the remaining provisions will remain in full force and effect.

25. Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision. Any waiver must be in writing and signed by an authorized representative of Deco AI.

26. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms presented to you for specific features, purchases, or promotions, constitute the entire agreement between you and Deco AI regarding the Services and supersede any prior or contemporaneous agreements relating to the Services.

27. Changes to These Terms

We may update or modify these Terms from time to time to reflect changes in our Services, legal obligations, business practices, or user needs.

When we make changes, we may update the "Last updated" date above, post the revised Terms on our website, provide an in-app notice, or notify you by other reasonable means.

Your continued use of the Services after the updated Terms become effective means you accept the revised Terms.
